Terms & Conditions
1. General
These terms apply to all purchases from Katherine Gibson Art (ABN: 94720240939). By placing an order, you agree to these terms.
2. Product Accuracy (The "Screen vs. Reality" Clause)
Every effort is made to display the colors and textures of my oil paintings accurately. however:
• Color Variation: Due to different monitor settings, the colors of the physical print or painting may vary slightly from what you see on your screen.
• Scale: Please refer to the specified dimensions in the product description. Mockup images are for inspiration and may not be to exact scale.
3. Refunds and Returns (ACL Compliance)
I want you to love your art. Under Australian Consumer Law, you are entitled to a replacement or refund for a major failure (e.g., the item arrives broken or is the wrong painting).
• Change of Mind: Because prints are made-to-order via Printify and original works are one-of-a-kind, I do not offer refunds or exchanges for "change of mind" or incorrect size selection. Please choose carefully.
• Damaged Goods: If your order arrives damaged, you must notify me at sales@katherinegibsonart.com within 48 hours of delivery with clear photos of the damage and the packaging. I will arrange a replacement at no extra cost to you.
4. Shipping & Delivery
• Processing Time: Prints usually ship within 3–7 business days. Originals may take up to 14 days to be safely packed.
• International Orders: Buyers are responsible for any local customs duties or import taxes. I am not responsible for delays caused by customs or third-party postal services.
• Incorrect Address: If a package is returned to me due to an incorrect address provided by the customer, a re-shipping fee will apply.
5. Intellectual Property
Katherine Gibson retains all copyright to the artwork, including the right to produce reproductions of any original painting sold. The purchase of an artwork does not transfer any reproduction rights to the buyer.
6. Governing Law
These terms are governed by the laws of Western Australia.
